After I wallowed in irritation and disappointment over his statement, I went back and read something I remembered from another time I was disappointed, back in 2005 over the John Roberts appointment:

We in the netroots/progressive community ache for someone to stand up and take a hard line when it comes to gutting the Constitution and letting criminals go free, but at the same time, we do need to consider that fixing this breach is not realistically going to happen under the current administration and congress/senate. Senator Obama is essentially telling us that he is taking what he believes to be most effective approach over the long term – working to elect enough senators and representatives to pass good legislation, and a president who will not veto it.

Feingold and Dodd will fiilibuster this time (neither of them is at risk in this election, so they’re the obvious choices to lead), but they’re not likely to stop it. The senate did pass a far more odious bill first, remember.

All that said, I certainly have made phone calls and sent emails and let every one of them know exactly what I think of this POS.
